1. Acceptance of Terms
By accessing or using StressTest.pro (the "Service"), provided by stresstest.pro ("Company," "we"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. No Financial Advice
The Company is NOT a registered investment adviser, broker-dealer, financial planner, tax advisor, or legal advisor. We do not provide personalized financial advice, suitability assessments, or financial plans. Your use of the Service does not create a fiduciary or advisory relationship. The Service does not recommend buying, selling, holding, rebalancing, or avoiding any security, ETF, fund, asset, portfolio, or strategy. All outputs are generated purely from user-selected inputs, assumptions, historical data, and mathematical models.
3. Hypothetical Backtesting and Results
All backtests, Monte Carlo simulations, and projections are hypothetical and based on historical data. Past performance does not guarantee or predict future results. Results may not reflect actual trading conditions. Calculations may exclude or simplify taxes, trading commissions, bid/ask spreads, slippage, liquidity constraints, market impact, management fees, fund expenses, FX effects, inflation assumptions, dividend treatment, corporate actions, and rebalancing assumptions. Results may also be affected by survivorship bias, missing data, stale data, incorrect data, vendor limitations, or modeling assumptions.
4. User Responsibility
You are solely responsible for your own investment decisions. You agree to independently verify all outputs and consult qualified financial, legal, or tax professionals before making any decisions based on the Service. You are responsible for ensuring that any use of the Service complies with laws applicable to you.
5. Watchdog Alerts and Notifications
Watchdog alerts are automated monitoring and educational notifications based on user-selected preferences. They are NOT trading signals, financial advice, investment recommendations, emergency alerts, risk warnings tailored to your full financial situation, or instructions to take action. Delivery of alerts may be delayed, missed, inaccurate, or unavailable. You should not rely on Watchdog alerts as the sole basis for any investment decisions.
6. AI-Generated Insights
The Service uses Artificial Intelligence (AI) to generate educational summaries and narratives. AI summaries may be incomplete, inaccurate, outdated, or misleading. AI outputs are for educational purposes only and should not be treated as a financial advisor or a definitive source of truth. You must independently verify AI-generated explanations before relying on them.
7. Subscriptions and Payments
Subscriptions renew automatically at the end of each billing cycle unless cancelled. Billing is processed securely by our payment provider. Cancellation takes effect at the end of the current billing period. We do not provide partial-month refunds unless required by law or explicitly stated. Applicable taxes may apply. Failed payments may result in suspension or loss of access to the Service. We reserve the right to change plan features or pricing over time with notice.
8. Account Security and Acceptable Use
You are responsible for maintaining the confidentiality of your account credentials. You agree to use the Service only for lawful, personal, non-commercial analysis (unless a separate B2B agreement exists). You agree not to scrape, reverse engineer, or resell the data, algorithms, or outputs provided by the Service.
9. Intellectual Property
All rights, title, and interest in the Service, including its code, algorithms, and design, are owned by the Company.
10. User Inputs and Data License
By submitting data (such as portfolio weights and settings), you grant us a license to process this data to operate and provide the Service to you.
11. Third-Party Services and Data Providers
The Service relies on third-party market data and APIs. We do not guarantee the availability or accuracy of these third-party services.
12. Service Availability and Termination
We do not guarantee uninterrupted uptime or availability of the Service. We reserve the right to modify, suspend, or terminate the Service or your access to it at any time, for any reason, with or without notice.
13. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.
14. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, AND FITNESS FOR A PARTICULAR PURPOSE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING TRADING LOSSES). IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE LAST TWELVE (12) MONTHS.
16. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or losses arising from your use of the Service or your violation of these Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of California. Any dispute shall be resolved by binding arbitration in Santa Clara, California in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or class action.
